Are you in over your head? Are your creditors calling you every second at work, on your cell, bothering your friends and relatives looking for you. I can help but I want you to have the information you need to make an educated decision. First of all most of the other companies that are out there, I hate to say are scammers. I had one client come to my office for help. He said that he was in about 30,000.00 in debt and that he was paying a debt consolidation compnay in California to handle it. he was making monthy payments to them but the creditors continued to call him asking for payments. So the first lesson is that debt consolidation companies or sebt settlement companies DO NOT STOP THE CREDITORS FROM CALLING AND THEY DO NOT STOP LAWSUITS AND COLLECTIONS.
Next, I was told that he stopped using the company and asked for a refund of the $10,000.00 that he paid into the company. The company stated that the $10,000.00 was for prepaid fees and that before any creditor got paid the company would have to receive their fee in full. So the next lesson is the contract that they ask you to sign will have all kinds of hidden fees and you will never see any of your money again. Furthermore, the companies are out of State. What are you going to do against a company in Arizona or California? Nothing and they know that. By the time you figure out who and where they are they will be out of business. Me, on the other hand have beenpracticing law in New York and Florida since 1996 and 1997 respectively. You need to know who your dealing with and not go with some baloney from a salesman.
Next, let me explain how I work. First I will examine your finances in whole. We will sit down and personally go over your finances and I will explain what you can expect and whether bankruptcy is an option. If bankruptcy is not an option I will use all my legal experience to obtain a settlement with the creditors. If you get sued I will appear and defend the lawsuit on your behalf. The out of state companies do not even offer this. Second, if you have some savings or can come up with some cash to pay the creditors I will negotiate the best possible lump sum payment. If you dont have the means to pay anything then you need to place a monthly amount into an attorney escrow accout as forced savings. At such time when you do have enough saved I can settle with one or more of the creditors.
This is just a brief explanation but the one important thing is to always use an attorney. These are legal matters. You should deal only with an attorney not a slick salesman that will promise whatever you want to hear.
